We are delighted to announce that Emma Northover, Partner, has taken over the leadership of our Contentious Probate team. Emma is a Member of ACTAPS (Association of Contentious Trust and Probate Specialists).

Emma leads a talented and diverse team that includes:

While Peter, Shana, Grace, Anastasia, and Rebecca are based in Newton Abbot, Emma and Carole operate out of our Honiton office. However, all team members can travel between the 13 offices WBW operates from as client needs require, ensuring flexibility and accessibility across Devon, Cornwall and Somerset.

For those unfamiliar with the term, Contentious Probate refers to legal disputes surrounding inheritance matters, including challenging the legitimacy of a Will, disputes over inheritance claims, and resolving issues with estate administration. Our team is highly experienced in handling matters such as:

  1. Challenges to the validity of a Will, where there are concerns regarding the testator’s capacity, undue influence, or improper execution.
  2. Claims for financial provision under the Inheritance (Provision for Family and Dependants) Act 1975, allowing specific individuals to seek reasonable financial support if they believe they have been unfairly left out or inadequately provided for in a Will.
  3. Proprietary estoppel claims can arise when someone is promised an inheritance, but the promise is not honoured in the Will.
  4. Applications for removing Executors or Trustees due to mismanagement or failure to perform their duties.
  5. Applications for accounts and enquiries, providing transparency and accountability in estate administration.
