Resolve your dispute without going to court
Litigation can prove to be costly, particularly as cases approach a Court hearing. Timely mediation is becoming an increasingly popular and practical alternative to costly and protracted litigation. An experienced mediator will act on an independent and confidential basis liaising between the various parties to a dispute in order to promote the prospects of a negotiated settlement. In the majority of cases, a specific session is set aside for mediation normally lasting between half a day and a day depending on the nature of the dispute when all parties will get together at a specified venue in order to try and reach a settlement.
Mediation can be conducted in many ways. Some people like to sit around the table of a joint meeting throughout the mediation and discuss the issues in a case, whilst others prefer to retire to private rooms and instruct a mediator to move to and fro between the parties in an attempt to negotiate terms of settlement.
A good mediator will be flexible and receptive to the wishes of all parties. Mediation presents those who are involved in a dispute with a flexible and common sense alternative to an adversarial process which will ultimately impose a result on the proceedings. Whilst mediation is a voluntary process, Courts can sometimes look unfavourably upon parties who unreasonably refuse to attempt mediation.
