When planning your Will, you may wish to provide for loved ones who are disabled, so that they are looked after when you have died. An ideal way of doing this is to create such a Disabled Person's Trust in your Will.

This will help ensure many things, not least the fact that:-

1. The disabled individual will remain entitled to means tested benefits (provided the Trust is discretionary);

2. where the disabled individual does not have the requisite mental capacity administer their own financial affairs, a Deputyship application (a time consuming and lengthy process) to the Court of Protection need not be made;

3. the trust may qualify for special tax treatment.

Additionally, disabled people have rights in connection with the provision of goods and services, rights against discrimination and Community Care Assessments.
