This is the legal process for administering the deceased's estate after the assets have been collected and claims and debts have been settled. Once this has been completed and the probate has been obtained the estate can then be distributed in accordance with the Will

Where the deceased has left a valid Will, the individuals going through the process are called the Executors. Please refer to our Advising Executors section.

Where the deceased is has not left a Will, Administrators are appointed by the Probate Registry to carry out the same functions as the Executors, although the deceased's assets will be distributed in accordance with Statute and Common Law. Please also see our 'Intestacy' section.
