For those who are about to marry, protecting the assets which they have from a future partner can be an extremely sensitive subject. However with an increasing number of second marriages and the growth in popularity of pre-nuptial arrangements in other parts of the world, these are increasingly an issue for couples in England and Wales.

For many years WBW have advised upon pre-nuptial agreements, no matter the client's circumstances. These agreements, if entered into with the benefit of legal advice and with appropriate safeguards, can provide certainty at the beginning of a new relationship and should that relationship founder, provide certainty and ease the separation process.

What is a pre-nuptial agreement? »

A.

A pre-nuptial agreement is an agreement entered into by both parties to a marriage before the marriage takes place. Ideally, it should include full details of their financial circumstances immediately prior to entering into the agreement and confirm the arrangements which will take effect in the event that the relationship breaks down.

It should be completed at least a month before the marriage.

Such agreements are not legally binding but if properly completed, they are regarded as good evidence of what is intended. Agreements are most commonly used where there is a financial imbalance between the parties and in the contributions being brought to a marriage by one party.
