Everyone wants the best education for their child but in certain circumstances it may prove difficult to obtain the appropriate help and assistance. WBW Solicitors can support parents in difficult situations relating to their children's education.

Problems with education may include the following:-

  1. Admissions - If your child has been turned down for a place at the school you want you should be told why. WBW Solicitors can assist you in an appeal against any decision to the Local Authority and assist you with any representations that need to be made to the school's Governing Body. WBW Solicitors can assist you in preparing your appeal and can represent you at an appeal hearing.
  2. School Placement - By law the Local Authority must find a place at school for your child. If your child does not have a school placement WBW Solicitors can assist you in communicating with the Local Authority and any proposed school that you may select. It may be possible to take legal action against a Local Authority where a place for your child has not been allocated.
  3. Travelling to school - The Local Authority will provide free transport to school if your child lives more than the legal walking distance from the nearest suitable school. From time to time issues arise with regard to transport costs. WBW Solicitors can assist in communicating with the Local Authority on this subject.
  4. Exclusion from school - If the school wants to exclude your child it must have a good reason for doing so. It must tell you how long your child will be excluded for. WBW Solicitors can assist in making representations against exclusion. WBW Solicitors can represent you before the Governing Bodies Panel and in the event of an appeal WBW Solicitors can represent you at the Independent Appeal Panel Hearing.
  5. Special Educational Needs - If you think your child has special educational needs then you can ask the Local Authority for a statutory assessment. WBW Solicitors can assist in this process and represent you at a hearing of an appeal to the Special Educational Needs and Disability Tribunal.
  6. Disability Discrimination - If you think your child is being treated unfairly at school because of a disability WBW Solicitors can assist you in your representations at the school and also in a complaint to the Special Educational Needs and Disability Tribunal (SENDIST).
  7. Educational Negligence - If your child has not received the appropriate level of education and has suffered a loss as a consequence WBW Solicitors can advise in matters of educational negligence. Legal action may well be possible against the Local Authority who have a responsibility for the performance of the relevant school.
