A man who fathered a child for a lesbian couple and then sought a contact order, contrary to his initial agreement with them, has been successful in the Court of Appeal.

After changing his mind, he applied for an order to increase contact with his child. His application was opposed by the couple.

However, the Court considered that a relationship with the father could be valuable for the child and that having a ‘third parent’ is not necessarily disadvantageous. In so deciding, the Court commented that it did not endorse the concept of ‘principal and secondary’ parents. The child’s welfare is the only consideration.

The case was remitted back to the family court for contact arrangements to be determined.
