Court of Appeal Revises Settlement in First Big Money Civil Partnership CasePrintPdfClose »

One of the first ‘big money’ cases involving the break-up of a civil partnership has been heard by the Court of Appeal.

The appeal concerned the decision of the family court to award £1.7 million to actor Donald Gallagher after his civil partnership with Peter Lawrence broke up.

Mr Lawrence claimed that he was the sole owner of a London property now valued at £2.4 million and that it should not therefore have been taken into account when the couple’s joint assets were being considered for division.

Although the Court did reduce the settlement to Mr Gallagher, it was adamant that each of the two men should benefit from the increase in value of the London property during the ten years they were together. The property had increased in value much more than a country cottage the pair owned in Sussex.

The case confirms that the principles applying to the divorce of married couples will be applied equally to the dissolution of civil partnerships.
