A man who acted as a sperm donor so that a lesbian couple could have a baby, and who agreed not to seek parental rights, has found himself in the Court of Appeal after his subsequent change of mind led to the Family Court allowing him visitation rights.

After the Family Court allowed him the right to visit the child for five hours each fortnight, the couple appealed against the decision, claiming to feel ‘bitter and betrayed’ as a result of his conduct. They gave evidence that had they known he would renege on his initial agreement, they would have sought an anonymous donor.

The decision in this case is expected shortly and could have significant implications in cases in which sperm donors or surrogate mothers are involved.
